Pennsylvania Federal Ballot Access Case Moves Ahead

A U.S. District Court in Reading, Pennsylvania, will hold a pre-trial conference in Constitution Party v Cortes on September 22. Here is the latest brief filed by the three minor parties in the case; it was filed September 10.

The case challenges the constitutionality of Pennsylvania’s unique system of requiring petitioning candidates to pay the costs of checking their signatures, if their petitions are found to lack enough valid signatures. The case also challenges Pennsylvania for failing to tally write-ins for some candidates on a completely arbitrary basis, and for failing to count any write-ins whatsoever in certain counties. Finally it challenges the state’s 15% registration membership requirement, to keep a party on the ballot. The 15% registration membership is so tough, it would even require the Utah Democratic Party, and the Massachusetts Republican Party, to submit petitions for all of their nominees, if the Pennsylvania law existed in those other two states. No party in any state, other than the Democratic and Republican Parties, has ever held even 5% of any state’s registration in at least 80 years, much less 15%.

Dr. Marshall De Rosa, Political Science professor at Florida Atlantic University ( http://www.youtube.com/watch?v=Yy27phHLmoc&feature=related) announced his Constitution Party candidacy for the United States Senate on Saturday, July 4th, 2009 at Jonathan Dickinson State Park.

Professor De Rosa spoke of his decision to seek the U.S. Senate seat as a candidate with the country’s fastest- growing third party (http://www.ballotaccess.org/) saying, "The time is short and the opportunities for preserving the constitutional rule of law are few. It simply will not happen by relying on the two parties now controlling our government. Americans have come to realize the duopoly in D.C. does not have their best interests in mind.

Government has extended its tentacles into virtually every aspect of our lives and the pockets of generations not yet born.
"My candidacy offers the people of Florida the chance to "opt out" of the endless cycle that has so devastated our country."

Dr. De Rosa received his Ph.D. and M.A. from the University of Houston and has taught at Louisiana State University and Davis and Elkins College. He is an adjunct faculty member for the Ludwig von Mises Institute, a Salvatori Fellow of the Heritage Foundation, and a member of the Philadelphia Society.

His publications include The Confederate Constitution of 1861: An Inquiry Into American Constitutionalism (University of Missouri Press) and The Ninth Amendment and the Politics of Creative Jurisprudence (Transaction Publishers) and most recently Redeeming American Democracy (Pelican Publishing Company 2007). Professor De Rosa has spent the past 36 years studying American politics and institutions.

Well known political activist and former director of the Save Our State organization in California, Chelene Nightingale, has announced her candidacy for the American Independent Party nomination for Governor of California in 2010. Nightingale (shown above with Tom Tancredo and former Border Agent Ignacio "Nacho" Ramos) is a loyal supporter of the national Constitution Party. She made her dramatic announcement at the 2009 "Operation Secure America Now" event at Camp Vigilance at the California border on July 4. Nightingale has already established a first class campaign operation and is expected to make a major impact on the California statewide General Election race next year.
